Соответствующий документ Госдума РФ сегодня, 19 мая, принимает в заключительном третьем чтении.
В России на сегодняшний день действует норма, согласно которой за ряд повторных нарушений ПДД предусмотрено более суровое наказание. К примеру, для водителей, в очередной раз превысивших скоростной лимит на 40-60 км/ч, штраф составит 2 тыс. – 2,5 тыс. рублей, тогда как за первое такое нарушение размер взыскания составляет 1 тыс. – 1,5 тыс. рублей. Либо проезд на запрещающий сигнал светофора: в первый раз автомобилист платит 1 тыс. рублей, при повторном нарушении он может лишиться прав на срок до одного года. В разы ужесточается наказание и для нетрезвых водителей-рецидивистов.
При этом повторным считается не каждое следующее нарушение ПДД: рецидивами признают только те случаи, которые произошли в течение следующего года. Недавно возник спор о том, от какого именно момента необходимо отсчитывать этот самый год. Теперь норму определили, и сегодня Госдума РФ принимает соответствующий законопроект в третьем чтении.
Поправки к статье 4.6 Кодекса об административных правонарушениях включают в себя описание механизма исчисления срока, в течение которого автомобилист-нарушитель имеет некий статус «подвергнутого усиленному наказанию».
Согласно действующей норме, год для нарушителя исчисляется с момента вступления штрафного постановления в силу. По новым правилам, стартовой точкой отсчёта станет момент оплаты водителем штрафа (нередко нарушители платят взыскание до вступления документа в силу, это, в частности, позволяет многим обойтись только 50% от положенной по закону суммы). То есть «обнуляться» срок действия усиленного наказания будет ровно через год после того, как водитель уплатил штраф за первое нарушение.
Причина для споров в данном вопросе появилась после того, как было рассмотрено дело автомобилистки из Костромской области. Она в июле 2018 года получила штраф за превышение скоростного лимита, уплатила его до вступления постановления в силу, а в следующем году пришло удвоенное взыскание, так как инспекторы считали срок с момента вступления постановления в силу. В итоге она обратилась в областной суд, который затребовал разъяснений в Конституционном суде РФ. КС в свою очередь признал статью 4.6 КоАП «влекущей неоднозначное понимание» и «возможность её произвольного применения». Итогом стал законопроект, разработанный МВД, который должен убрать имеющуюся неопределённость.
Как сообщает «Коммерсант», большинство подразделений ГИБДД и раньше исчисляли срок для усиленного наказания для рецидивистов именно с момента оплаты предыдущего штрафа. Однако в Костромской области в 2019 году решили поступить иначе. Согласно подсчётам ведомства, на сегодняшний день в РФ свыше 80% штрафов водители оплачивают в течение 20 дней, чтобы успеть воспользоваться скидкой.
Напомним, недавно власти снова вернулись к обсуждению необходимости уменьшить «нештрафуемый порог» вдвое. Предполагается, что новая норма должна действовать только на территории населённых пунктов, а на трассах по-прежнему оставят «+20 км/ч». МВД и Минтранс обязали предоставить «согласованную позицию» по этому вопросу к 1 августа текущего года.
